الشروط والأحكام العامة

أولاً: القبول والنطاق

باستخدامك لموقع nicetopteck.com أو إتمامك لأي طلب شراء، فإنك تُقرّ بقراءة هذه الشروط والموافقة عليها كاملةً. تسري هذه الشروط على جميع الزوار والمشترين وتُحكمها أنظمة المملكة العربية السعودية.

ثانياً: تعريف أيام العمل

يُقصد بـ"أيام العمل" في جميع سياسات المتجر الأيامُ من الأحد إلى الخميس، باستثناء أيام الإجازات الرسمية في المملكة العربية السعودية.

ثالثاً: طبيعة العقد وآلية إتمامه

يُعدّ الطلب المقدَّم من العميل طلباً أولياً يخضع للمراجعة، ولا ينعقد عقد البيع إلا بعد: مراجعة الطلب والتحقق من إمكانية تنفيذه، إصدار إشعار التأكيد الرسمي للعميل، واعتماد الطلب وتسليمه لشركة الشحن.

رابعاً: الأسعار والضريبة

• الأسعار بالريال السعودي وتشمل ضريبة القيمة المضافة (15%) وفق أنظمة الزكاة والضريبة والجمارك.
• السعر المعتمد هو السعر الظاهر لحظة تأكيد الطلب من طرف المتجر.
• يحق للمتجر تعديل الأسعار دون الإخلال بالطلبات المؤكَّدة مسبقاً.

خامساً: الفاتورة الضريبية الإلكترونية

تُصدر الفواتير الضريبية الإلكترونية وفق اشتراطات هيئة الزكاة والضريبة والجمارك (زاتكا) عبر منظومة الفوترة المعتمدة في المتجر.

سادساً: المدفوعات ومزودو خدمة الدفع

تُنفَّذ جميع عمليات الدفع عبر مزودي خدمة دفع مرخّصين من البنك المركزي السعودي (ساما)، وتخضع كلياً لسياسات تلك الجهات وإجراءاتها وشروطها الخاصة.

تنبيه: لا يُعدّ المتجر طرفاً في عمليات معالجة المدفوعات، ولا يتحمل أي مسؤولية عن النزاعات أو التأخير أو الأخطاء الناجمة عن مزود خدمة الدفع. في حال واجه العميل أي إشكالية تتعلق بالدفع، يُرجى التواصل مباشرةً مع مزود خدمة الدفع المعتمد.

تظل جميع الحقوق المالية للعميل المكفولة بالأنظمة السعودية محفوظةً في جميع الأحوال.

سابعاً: الامتثال للشريعة الإسلامية

يلتزم المتجر بإجراء جميع معاملاته التجارية وفق مبادئ وأحكام الشريعة الإسلامية:

• جميع المنتجات والخدمات المعروضة مباحة شرعاً.
• لا يفرض المتجر أي فوائد ربوية أو رسوم خفية، وتكون جميع التكاليف معلنةً قبل إتمام الطلب.
• مزودو خدمات الدفع والتقسيط مسؤولون عن توافق خدماتهم مع الضوابط الشرعية والأنظمة المعمول بها.
• لا ينعقد عقد البيع إلا بعد التحقق من إمكانية تنفيذ الطلب والقدرة على تسليمه.
• تتم جميع الإجراءات بما يحقق الشفافية وحفظ حقوق جميع الأطراف.

ملاحظة: لا يتحمل المتجر مسؤولية شروط أو منتجات شركات الدفع أو الجهات التمويلية المستقلة، إذ تخضع تلك الخدمات لاتفاقيات وسياسات خاصة بين العميل ومقدّم الخدمة.

ثامناً: الملكية الفكرية

جميع محتويات الموقع ملكية خاصة لـ Nice Top Teck، محمية وفق نظام الملكية الفكرية السعودي. يُحظر نسخها لأغراض تجارية دون إذن كتابي مسبق.

تاسعاً: حل النزاعات

يحكم هذه الشروط النظامُ السعودي. نسعى للحل الودّي أولاً عبر info@nicetopteck.com. فإن تعذّر، يُحال النزاع للجهات القضائية المختصة في المملكة.

عاشراً: اللغة المرجعية

هذه الشروط وجميع سياسات المتجر متوفرة باللغتين العربية والإنجليزية. في حال وجود أي تعارض في التفسير بين النسختين، تُعتمد النسخة العربية مرجعاً أساسياً.

General Terms and Conditions

1. Acceptance and Scope

By accessing nicetopteck.com or placing any order, you confirm that you have read and fully agreed to these Terms. They govern all visitors and buyers and are subject to the laws of the Kingdom of Saudi Arabia.

2. Definition of Business Days

"Business days" throughout all store policies refers to days from Sunday through Thursday, excluding official public holidays in the Kingdom of Saudi Arabia.

3. Nature of Contract and Completion

An order constitutes a preliminary request subject to review. A binding sale contract is formed only after: order review and fulfillment verification, issuance of an official confirmation notice to the customer, and order approval and handover to the shipping carrier.

4. Pricing and VAT

• Prices are in Saudi Riyals and include 15% VAT in accordance with ZATCA regulations.
• The confirmed price is that displayed at the time of store order confirmation.
• The store reserves the right to update listed prices without affecting previously confirmed orders.

5. Electronic Tax Invoices

Electronic tax invoices are issued in compliance with ZATCA requirements through the store's approved invoicing system.

6. Payments and Payment Service Providers

All payment transactions are processed through payment service providers licensed by the Saudi Central Bank (SAMA), and are governed entirely by those providers' own policies, procedures, and terms.

Important Notice: The store is not a party to any payment processing operation and bears no responsibility for disputes, delays, or errors arising from a payment service provider. Customers experiencing payment issues should contact their payment service provider directly.

All financial rights of the customer guaranteed under applicable Saudi regulations remain fully preserved.

7. Shariah Compliance

The store conducts all commercial transactions in accordance with Islamic Shariah principles:

• All products and services offered are permissible under Islamic law.
• No interest-based charges or hidden fees are imposed; all costs are disclosed prior to order completion.
• Payment and financing service providers are solely responsible for the Shariah compliance of their own offerings.
• A sale contract is concluded only after verifying the ability to fulfill and deliver the order.
• All procedures are conducted with full transparency and in protection of all parties' rights.

Note: The store bears no responsibility for the terms or financing products of independent payment companies or financial institutions, as those services are governed by separate agreements between the customer and the service provider.

8. Intellectual Property

All website content is the exclusive property of Nice Top Teck, protected under Saudi intellectual property law. Commercial reproduction without prior written consent is prohibited.

9. Dispute Resolution

These Terms are governed by Saudi law. Amicable resolution is sought first via info@nicetopteck.com. Unresolved disputes are referred to the competent judicial authorities in the Kingdom.

10. Governing Language

These Terms and all store policies are available in both Arabic and English. In the event of any conflict in interpretation between the two versions, the Arabic version shall serve as the primary reference.
